ENA License Revoked: What Happens Next?

The Public Services Regulatory Commission (PSRC) has made a decision to revoke the license granted to "Electric Networks of Armenia" company, "Tashir Capital." However, as PSRC Chairman Mesrop Mesropyan noted, the process does not end with this decision and will have a continuation.
Commission member Ara Nranyan voted against the decision, raising legal concerns. He justified his position with the ongoing case in the Constitutional Court, which concerns the relevant legislative change. "If the Constitutional Court, on December 16, recognizes any point of the legislative change as unconstitutional, then this whole process may become unconstitutional," Nranyan said.
PSRC Chairman Mesrop Mesropyan presented the further steps stemming from the decision. According to him, in the next three months, the state will start negotiations with the owner of ENA or the board of directors regarding the transfer of property ownership rights. "If the parties do not reach an agreement within those 3 months, the state can take the ownership right under the right of eminent domain," Mesropyan stated.
He also suggested that the parties will try to protect their rights in other judicial instances, which means that the process may be prolonged.
